§ 1 Contracting parties

1. These General Terms and Conditions (hereinafter “GTC”) govern the business relationship between Mario und Angelo Russillo GbR, Schlossstraße 1, 12163 Berlin, Germany (hereinafter “di Russillo”) and the buyer (hereinafter the “Customer”).

2. All supplies and services provided by di Russillo are provided exclusively on the basis of these GTC in the version applicable at the time the order is placed. They form part of the contract and apply exclusively to this business relationship.

§ 2 Conclusion of contract

1. The order placed by the Customer constitutes a binding offer. The purchase contract becomes legally binding, to that extent, upon its acceptance by di Russillo.

2. The Customer may place an order via web browser, by telephone or by email. Before final production, the Customer may amend or cancel the order.

3. If the Customer withdraws in the manner defined in § 2(2), the Customer shall bear any costs already incurred and any resulting loss of revenue.

4. The Customer guarantees that it will sell or use the products ordered from di Russillo in a manner that does not damage the public image.

§ 3 Prices and terms of payment

1. All prices are net as stated, plus the applicable VAT and, where applicable, shipping costs.

2. Our invoices are payable without deduction within 14 days of the invoice date. Any other payment terms must be agreed individually.

2.1 Where an order has been processed online, the above period runs from receipt of the electronic invoice.

2.2 In the case of cash settlement (cash payment), the amount payable is due immediately upon delivery, without deduction.

§ 4 Terms of delivery

1. Orders must be placed at least 12 hours before the time of delivery (date and time).

1.1 If the Customer’s address is more than 20 km from the company’s registered office (Schlossstraße 1, 12163 Berlin), at least 24 hours’ notice is required.

1.2 Deliveries within Germany are made by freight forwarder.

2. No additional delivery charges apply to deliveries within 20 km of the company’s registered office (see § 4(1.1)). Deliveries beyond this radius are subject to a flat delivery fee of €20.00. It is at di Russillo’s discretion when, and from what delivery distance onwards, an order is dispatched by freight forwarder.

3. di Russillo undertakes to inform the Customer without delay if an order cannot be delivered. Accordingly, di Russillo is entitled to withdraw from the contract if the goods are unavailable.

§ 5 Retention of title

1. The goods remain the property of di Russillo until the invoice has been paid in full.

2. The Customer undertakes to treat the goods with care until ownership passes in accordance with § 5(1).

3. For as long as ownership of the goods has not passed in accordance with § 5(1), the Customer must inform di Russillo without delay of any seizure of the goods or other interference by third parties.

§ 6 Warranty

The Customer’s claims against di Russillo in respect of defects are governed by the statutory provisions and are subject to the statutory time limits.

§ 7 Images

1. Any use of di Russillo’s images requires the prior written consent of di Russillo. Such consent only permits use for purposes that do not damage the public image of di Russillo.

2. The permission to use images granted under § 7(1) may not be passed on to third parties. All images remain the property of di Russillo.

§ 8 Product images

The goods/products are supplied as shown in the online ordering portal, but without decoration.
