Data on this website is processed by the website operator. You will find the operator’s contact details in the section “Information on the controller” in this privacy policy.

You have the right at any time to obtain information, free of charge, about the origin, recipients and purpose of your stored personal data. You also have the right to request the rectification or erasure of this data. If you have given your consent to data processing, you can withdraw this consent at any time with effect for the future. In addition, you have the right, under certain circumstances, to request the restriction of the processing of your personal data. You also have the right to lodge a complaint with the competent supervisory authority.

The controller responsible for data processing on this website is:

Storage period

Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for which it was processed no longer applies. If you assert a legitimate request for erasure or withdraw your consent to data processing, your data will be erased unless we have other legally permissible grounds for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be erased once these grounds no longer apply.

General information on the legal bases for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or, where special categories of data under Art. 9(1) GDPR are processed, Art. 9(2)(a) GDPR. If you have explicitly consented to the transfer of personal data to third countries, the processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information in your terminal equipment (e.g. via device fingerprinting), the processing is additionally based on Section 25(1) TTDSG. Consent can be withdrawn at any time. If your data is required for the performance of a contract or to take pre-contractual steps, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data on the basis of Art. 6(1)(c) GDPR where this is necessary for compliance with a legal obligation. Data may also be processed on the basis of our legitimate interest under Art. 6(1)(f) GDPR. The legal basis applicable in each individual case is set out in the following paragraphs of this privacy policy.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The withdrawal does not affect the lawfulness of the processing carried out before the withdrawal.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF DATA IS PROCESSED ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE LEGAL BASIS ON WHICH A PARTICULAR PROCESSING OPERATION IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work or place of the alleged infringement. This right is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done where it is technically feasible.

Access, erasure and rectification

Within the scope of the applicable statutory provisions, you have the right at any time to obtain information, free of charge, about your stored personal data, its origin and recipients and the purpose of the processing and, where applicable, the right to have this data rectified or erased. You can contact us at any time about this or any other questions on personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us about this at any time. The right to restriction of processing applies in the following cases:

  • If you contest the accuracy of the personal data we hold about you, we will usually need time to verify this. For the duration of this verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was or is unlawful, you can request the restriction of processing instead of erasure.
  • If we no longer need your personal data but you need it for the exercise, defence or establishment of legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.
  • If you have objected under Art. 21(1) GDPR, your interests and ours must be weighed against each other. Until it has been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent, for the establishment, exercise or defence of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a member state.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the browser’s address bar changing from “http://” to “https://” and by the padlock symbol in your browser bar.

When SSL or TLS encryption is activated, the data you send us cannot be read by third parties.

Objection to advertising emails

We hereby object to the use of the contact details published under our legal obligation to provide an imprint for the purpose of sending advertising and information material that we have not expressly requested. The operators of this website expressly reserve the right to take legal action in the event of unsolicited advertising material being sent, for example by spam email.

4. Data collection on this website

No cookies, no tracking

This website does not set any cookies and does not use any analytics or tracking tools. Fonts, images and all other content are loaded from our own web server. No connection to the servers of other providers is therefore established when you visit our pages.

Server log files

The provider of these pages automatically collects and stores information in what are known as server log files, which your browser transmits to us automatically. This information is:

  • browser type and browser version
  • operating system used
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • IP address

This data is not combined with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the technically error-free presentation and the security of our website; for this purpose, the server log files must be recorded.

Contact form

If you send us enquiries via the contact form, the information you provide in the form, including the contact details you enter there, will be stored by us for the purpose of handling your enquiry and in case of follow-up questions. We do not pass this data on without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry relates to the performance of a contract or is necessary to take pre-contractual steps. In all other cases, the processing is based on our legitimate interest in effectively handling the enquiries sent to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to erase it, withdraw your consent to its storage or the purpose of storing the data no longer applies (e.g. once your enquiry has been dealt with). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Booking and contact form

Our booking form asks for your first name, last name, phone number, email address, location, number of guests, date and time, and optionally for additional information (e.g. occasion or allergies). Our contact form asks for your first name, last name, phone number, email address and your message, and optionally for a location. The forms also transmit the address of the page from which you sent the form and the date and time it was sent.

Your information is processed by a script on the server of our hosting provider goneo and sent by email to our mailbox info@russillo.de. Your information is not stored in a website database.

To protect against misuse (e.g. large numbers of automatically sent enquiries), the script stores a hash value of your IP address for each enquiry, together with the time of the enquiry. Your IP address itself is not stored in plain text. This data is used solely to limit the number of enquiries per hour and is deleted after two days. The legal basis is our legitimate interest in the secure operation of the forms (Art. 6(1)(f) GDPR).

In all other respects, the information in the section “Contact form” applies to the processing of your enquiry. If your enquiry is a request to book a table, the legal basis is Art. 6(1)(b) GDPR.

Enquiries by email, phone or fax

If you contact us by email, phone or fax, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of dealing with your request.

The data you send us in contact enquiries will remain with us until you ask us to erase it, withdraw your consent to its storage or the purpose of storing the data no longer applies (e.g. once your request has been dealt with). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
